7 Parenting Tips for Working from Home with Young Children Little ...

[By L.R.Knost, author of ?Two Thousand Kisses a Day: Gentle Parenting Through the Ages and Stages now available on Amazon]

busy momWith economies struggling all over the world, more and more moms are trying to juggle work and children. Working from home is one way to earn a living or supplement your household income while still parenting full-time, but it comes with its own unique set of challenges. Here are seven tips to help you parent your little ones gently while operating a home business:

1. Think ?routine? instead of ?schedule.? Gentle parenting is very much about being in-sync with your child?s needs. Being tied to an inflexible schedule will only cause stress and conflict as your child?s needs evolve from day to day, week to week, month to month, and year to year. Children do, however, enjoy the comfort and familiarity of a regular routine, and knowing what to expect helps them to make transitions throughout the day. So, instead of making a minute to minute schedule, try working with your child to establish a routine that?s flexible enough to adjust to meet their fluctuating needs, but builds into your day the time you need to devote to your work. For example, a routine could look something like this:

    • Morning cuddles, breakfast, playtime with mommy
    • Playtime while mommy works
    • Snack and storytime with mommy
    • Play while mommy works
    • Lunch and outside playtime with mommy
    • Naptime while mommy works
    • Playtime with mommy
    • Playtime while mommy works
    • Help mommy with dinner
    • Dinnertime
    • Help mommy clean up after dinner
    • Playtime while mommy works
    • Evening snack
    • Bathtime, bedtime story, cuddles, night-night time

Notice that there are no time limits, only a loose plan for the day that you can adjust if your little one is sick or teething or just needs some extra mommy time during the day. A younger baby will need more naps during the day and can be worn in a baby carrier for naps and/or in place of playtime, and some toddlers and preschoolers will outgrow their need for naps earlier than others, and some will need more outside time, etc. so you?ll want to come up with a routine that accommodates your child?s age, sleep needs, and temperament. Also, of course, if your spouse or a trusted family member or friend is available to help, be sure to include them in your routine.

    2. Children love the novelty value of new toys, so get a box for each of your working days of the week. Label each box with one day of the week and place a set of toys in them that you only bring out on that day. Remember to think outside the box (lol) and don?t only choose store-bought toys. One box could be full of paper towel and toilet paper tubes and various sizes of bouncy balls and hot wheels, etc. so your little one can make tunnels and chutes and all sorts of inventions. Another box could have kitchen utensils and bowls and pots and pans. Don?t be afraid of a little mess, either! Children are washable, and messy play can keep them happily engaged for long stretches of time, so in one box you could have a plastic tablecloth from the dollar store or even a little blow-up wading pool, some paintbrushes, and shaving cream. Just put down the tablecloth or blow up the pool and add a touch of different colors of food coloring to a few small bowls of shaving cream let your little Picasso go to town! The trick is to be creative and choose things that are out of the ordinary that will engage your child?s imagination, not just keep them busy.

    3. For older preschoolers or early elementary ages, an independent project is an excellent idea to help them stay happily engaged while you?re working. During your work periods, provide your child with an ongoing project that they?re interested in and can work on independently. It can be a paint-by-number project, a jigsaw puzzle, a simple model car, a jewelry making set, or any number of other things. Since time is a hard concept for young children, setting a timer for your work periods and having a little sticker chart on the fridge for you and your child to ?clock in? and ?clock out? of work might be a fun, helpful part of your routine, as well.

    4. Meal planning is a huge, huge help in freeing up time and mental energy. Take the time to write out a list of every meal you know how to make that your family likes, then break each of those meals down into their ingredients. Save the list on your laptop, and then twice a month simply cut and paste two weeks of meals into a Word doc. Then print it out, cross off any ingredients you already have on hand, and ?voila? you have a shopping list and menu for two weeks done in one shot!

    5. Simplify, simplify, simplify. Be realistic about your commitments and expectations for yourself. Have fruit and cheese for breakfast most mornings instead of eggs and pancakes and sausage. It?s healthier, faster, and there?s less to cleanup! Resign from any pre-working-at-home commitments you can such as directing your church?s Vacation Bible School or doing the book work for your local food pantry. No one expects you to be able to do everything, and someone else can take on those tasks while you?re doing double duty as a work-and-stay-at-home-mom. And, once you?ve cleared up your commitments, avoid the temptation to fill up your time with playgroups and playdates and mommy-and-me classes. Your little ones need you, not activities.

    6. Don?t be afraid to go mobile. Find a local park that is suitable for your child?s age and temperament (i.e. Don?t go to a park with a lake if your little one is a runner, and don?t choose a playground with only big kid slides and jungle gyms if you?ve got a toddler.). Once you?ve found a park that?s a good fit, take your laptop or iPhone and answer emails or return phone calls or do other simple tasks that you can manage while swinging your little one in a baby swing or watching your toddler dig in the sand. Make sure you take the time to play with them while you?re there, too, and don?t worry if you get a few judgmental looks from other parents. They don?t know your life, but you know you?re doing the best you can to meet your child?s needs while doing what you need to do for work, so take comfort in that knowledge.

    7. Don?t forget to take care of yourself! We can get so caught up in meeting our family?s needs at times that we forget to take care of our own needs. Make sure you include a bit of downtime in your routine each day to simply be still and have a cup of coffee or read the newspaper or simply stare out the window and daydream for a few minutes. Take the time on a regular basis to do your nails, go have your hair done, and make a lunch date with a friend. Even if you bring your little one with you, you?ll still be out and about in a non-working environment for a bit and actually get to feel like an adult. If you?ve got a teething baby or a sick child and aren?t getting much sleep at night, take a nap during the day when your little one?s asleep instead of working during their nap. You may get a bit less work done, but you?ll enjoy your life and your family more, and isn?t that really the point of it all anyway?

'Journey' sweeps Game Developers Choice Awards

SAN FRANCISCO (AP) ? "Journey" arrived on top at the Game Developers Choice Awards.

The artsy video game developed by thatgamecompany swept the 13th annual ceremony Wednesday with six wins, including game of the year and the innovation award. "Journey" was also honored for best audio, game design, visual arts and as best downloadable game.

"I really think the success of 'Journey' is because we're standing on the shoulder of the giants," said "Journey" designer and thatgamecompany co-founder Jenova Chen.

The wordless but emotional downloadable PlayStation 3 game casts players as a mysterious scarfed figure that must trek across a desert, through temples and toward a towering mountain. Other players appear online in the game, but they aren't able to communicate with words or sound.

"If you've played the game, you can imagine how difficult it was for the team to go through it," said Chen. "Particularly at the mountain, right before the end. It was very, very stressful. I actually had to go see a psychiatrist."

Selected by a jury of game creators, the Game Developers Choice Awards honor the best games of the past year.

Other winners at the Moscone Convention Center ceremony included Ubisoft's island shoot-'em-up "Far Cry 3" for best technology, Telltale Games' interactive zombie drama "The Walking Dead" for best narrative, Fireproof Studios' puzzler "The Room" for best handheld/mobile game. Arkane Studios' stealthy revenge tale "Dishonored" won the inaugural audience award, which was chosen by online votes.

Ray Muzyka and Greg Zeschuk, masterminds of such seminal role-playing games as "Baldur's Gate," ''Knights of the Old Republic" and "Mass Effect," were honored with the lifetime achievement award.

"Spacewar!" developer Steve "Slug" Russell received the pioneer award for his contribution to video games. Russell's "Spacewar!" was created in 1962 and is considered to be among the first digital computer games.

Chris Melissinos, creator of the Smithsonian American Art Museum's "The Art of Video Games" exhibit, was presented with the ambassador award, which recognizes individuals who have helped advanced the gaming industry.

"Thank you to all the game creators who have provided me with a lifetime of inspiration," Melissinos said while accepting his trophy. "You've had a much larger impact on the world than you may believe."

Restaurant meals for kids fail nutrition test: consumer group

    By Diane Bartz

WASHINGTON (Reuters) - The menus offered to children by most U.S. restaurant chains have too many calories, too much salt or fat, and often not a hint of vegetables or fruit, according to a study by the Center for Science in the Public Interest.

The group, which has agitated for everything from healthier popcorn at the movies to calorie labeling in supermarkets, found that among almost 3,500 combinations surveyed, kids' meals failed to meet nutritional standards 97 percent of the time.

That was a marginal improvement over 2008 when such meals failed to meet standards 99 percent of the time.

Every children's meal offered at popular chains such as Chipotle Mexican Grill, Dairy Queen, Hardee's, McDonald's, Panda Express, Perkins Family Restaurants and Popeyes fell short of standards adopted by the center from the U.S. Department of Agriculture's nutritional recommendations.

The meals also fell short of standards set by the National Restaurant Association's Kids LiveWell Program, said the CSPI, which titled its study, "Kids' Meals: Obesity on the Menu."

"Most chains seem stuck in a time warp, serving up the same old meals based on chicken nuggets, burgers, macaroni and cheese, fries, and soda," said Margo Wootan, CSPI nutrition policy director. "It's like the restaurant industry didn't get the memo that there's a childhood obesity crisis."

Among the meals singled out was Applebees' grilled cheese sandwich on sourdough bread, fries and two percent chocolate milk, which has 1,210 calories, 62 grams of fat and 2,340 milligrams of sodium.

The combo meal had nearly three times as many calories as the CSPI's criteria for four- to- eight-year-olds suggest.

At Ruby Tuesday, the macaroni and cheese, white cheddar mashed potatoes and fruit punch combo has 870 calories, 46 grams of fat and 1700 milligrams of sodium, said Wootan.

The U.S. Centers for Disease Control and Prevention has recommended that children eat no more than 2,300 milligrams of salt each day to avoid high blood pressure, which can lead to coronary disease, stroke and other ailments.

Being overweight as a child leaves a person vulnerable to heart disease, diabetes and a shortened life span. About one-third of American children are now considered overweight and 17 percent are considered obese, according to USDA's Dietary Guidelines for Americans.

The CSPI cited Subway restaurants' Fresh Fit For Kids meal combinations as exceptions to the salty, fatty norm.

Subway serves apple slices with its kid-sized sub sandwiches and offers low-fat milk or bottled water instead of soda. All eight of its children's meals met CSPI's nutrition criteria.

A few other establishments have begun to offer side dishes beyond French fries. In fact, every child's meal at Longhorn Steakhouse now comes with fruit or a vegetable.

"More chains are adding fruit, like apple slices, to their menus, but practically every chain could be adding more vegetable and whole grain options," said Ameena Batada, an assistant professor in the Department of Health and Wellness at the University of North Carolina Asheville.

Labeling can be a potent tool. The report cited two studies that indicated customers who are provided with calorie counts on the menu sometimes gravitate toward healthier choices.

To produce its study, the CSPI looked at 50 top U.S. chain restaurants, finding 34 of them had meals designed for children and were willing to provide nutritional data. It analyzed those meals and meal combinations.

Mar 27 - Downloaders face personal legal warnings as US steps up ...

As new download detection and copyright protection systems are phased into effect stateside, suspected violators have begun to receive warnings of ?serious legal and other consequences? from media companies like NBC Universal.

In one instance, a user of the popular file sharing system BitTorrent was dispatched a notice from the media giant for allegedly downloading a television show.

According to TorrentFreak, NBC Universal sent the threatening notice to a user accessing the web through an Internet provider that is currently not participating in the 'six strike' system that detects and punishes Internet customers of several American providers who download illegally. The notice was similar to what copyright violators connected to the web using 'six strike' ISPs have begun to receive - and the language used in the notice is markedly more aggressive.

In addition to the threat of criminal prosecution, the notice sent to the downloader included the potential termination of their Internet service account.

?Copyright infringement also violates your Internet Service Provider?s terms of service and could lead to limitation or suspension of your Internet service.?

Under the new 'six strike' rules, by comparison, affiliated Internet providers are not compelled to disconnect file sharers, though more ambiguous consequences are said to include a slowdown in access speeds for repeat offenders, blocked access to popular websites, and even compulsory copyright education courses.

Kate Middleton: It's Great Your Baby Shower Is ... - Hollywood Life

Kate, your baby shower plans prove once again that you?re not afraid to throw out tradition and celebrate your pregnancy just like every other mom-to-be! Good for you for shaking up the ultra-staid monarchy with?your down-to-earth modern ways!

Kate Middleton, you?have proved time and time again that you are blowing the cobwebs out of the stuffy old monarchy, and we bet that your husband Prince William?just loves it! Now?your new plans for a baby shower?demonstrate that you?re not going to let the fact that you?ll be giving birth to the royal heir get in the way of celebrating becoming a mom. Apparently, major Royals ? including?Queen Elizabeth?and?Queen Victoria?? never had something so ?common? as a baby shower. But both you and Prince William love being as ?normal? as possible, just like William?s mom, the late Princess Diana.

Pregnant Kate Middleton: A Modern &?Revolutionary?Duchess

Kate, having your sister?Pippa Middleton?plan a ?relaxed and fun? baby shower is exactly what you need, especially given all the misery you endured at the beginning of your pregnancy with your extreme morning sickness. It?s terrific that you are so excited about becoming a mother and that you want to share your happiness with your close friends and family.

This is the latest way that you and?William?are revolutionizing the royal household by not conforming to rigid, old-fashioned traditions, but instead are making all your own decisions about what you believe is best for your precious baby. You and William will reportedly be hands-on parents, unlike almost all other heirs to the throne. Apparently, William plans to be by your side at your baby?s birth ? a first for a future king ? and you are refusing to hire a full-time nanny. William even plans to change his baby?s diapers! Hooray.

Furthermore, you both petitioned British Parliament to change the rules of succession to the throne so that your first-born child ? boy or?girl ? will ascend to the throne! That?s huge!

Finally, by having your baby in a hospital like Princess Diana ? instead of in the palace like some royals ? you are choosing what you want for your birth, instead of the kind of birth that might be expected for the wife of the future King of England.

Duchess Kate & Prince William: Modern Royal Parents

Kate, you going to be a great mom ? just like Princess Diana. Both you and William will shower your baby with love and affection, and you plan to take your child to school yourself, instead of relying on staff. Queen Elizabeth may have let her four children be raised by nannies with a ?viewing? or two a day, but not you.

You have repeatedly demonstrated over the years what a normal and down-to-earth person you are by buying your own groceries, cooking, walking your dog Lupo, and wearing a ?Baby on Board? sticker on your coat. You will be giving birth to one lucky baby!

So, Kate, enjoy your baby shower and have fun, and keep living your life like you are a normal person and a regular mommy- to -be, because you are positively glowing!

Ahmadinejad roadshow: Pitching his political heir

TEHRAN, Iran (AP) ? During a celebration last week to mark the Persian new year, President Mahmoud Ahmadinejad did something quietly remarkable: He stood modestly to the side and let his favored aide have the spotlight.

The gesture was far more than just a rare demure moment from the normally grandstanding leader. It was more carefully scripted stagecraft in Ahmadinejad's longshot efforts to promote the political fortunes of his chief of staff ? and in-law ? and seek a place for him on the June presidential ballot that will pick Iran's next president.

In the waning months of Ahmadinejad's presidency ? weakened by years of internal battles with the ruling clerics ? there appears no bigger priority than attempting one last surprise. It's built around rehabilitating the image of Esfandiari Rahim Mashaei and somehow getting him a place among the candidates for the June 14 vote.

To pull it off, Ahmadinejad must do what has eluded him so far: Come out on top in a showdown with Supreme Leader Ayatollah Ali Khamenei and the other guardians of the Islamic Republic. Ahmadinejad has been slapped down hard after bold ? but ultimately doomed ? attempts in recent years to push the influence of his office on policies and decisions reserved for the ruling clerics.

That has left him limping into the end of his eight-year presidency with many allies either jailed or pushed to the political margins. Mashaei is part of the collateral damage.

He's been discredited as part of a "deviant current" that critics say seeks to undermine Islamic rule in Iran and elevate the values of pre-Islamic Persia. The smear campaign has even included rumors that Mashaei conjured black magic spells to cloud Ahmadinejad's judgment.

The prevailing wisdom is that the backlash has effectively killed Mashaei's chances for the presidential ballot. The ruling clerics vet all candidates and, the theory follows, they seek a predictable slate of loyalists after dealing with Ahmadinejad's ambitions and disruptive power plays. In short: Friends of Ahmadinejad need not apply.

Khamenei and others, including the powerful Revolutionary Guard, also are hoping to quell domestic political spats that they fear project a sense of instability during critical negotiations with the West over Tehran's nuclear program.

Yet none of this seems to have discouraged Ahmadinejad, whose son is married to Mashaei's daughter. Ahmadinejad has been trying to groom Mashaei for years as his potential heir and now appears reluctant to toss his backing behind a less controversial figure.

To that end, the president has hit the road as a cheerleader for Mashaei under the slogan "Long Live Spring."

At one stop, Ahmadinejad described Mashaei as "a pious man." At another event he called him "excellent, wise," and at a third said his adviser has "a heart like a mirror."

At last week's event, both men burst into tears as they discussed the need to help children with cancer. Ahmadinejad then "thanked God for having the opportunity to get to know Mashaei."

Ahmadinejad appears to be banking on his populist appeal to force the Guardian Council ? the gatekeepers for the candidates ? to consider Mashaei too prominent to reject.

"Ahmadinejad doesn't want to go out with a whimper. That's not his style," said Mustafa Alani, an analyst at the Gulf Research Center based in Geneva. "He wants his legacy, his man, as his successor."

Tehran-based political analyst Sadeq Zibakalam also sees Mashaei as Ahmadinejad's last-ditch insurance policy. Without an ally as successor, Ahmadinejad fears he will be cast to the political sidelines.

"Ahmadinejad has no option but to get one of his loyalists into power," he said.

It will be more than a month before the candidate list is finalized. The presidential hopefuls will register from May 7-11, the semiofficial Fars news agency reported Monday.

Already, however, the general contours are taking shape.

There is Ahmadinejad's quest for Mashaei as the only active campaign roadshow.

Many conservatives, meanwhile, seem to be coalescing around a three-way alliance ? all apparently in the good graces of the ruling system ? of former Foreign Minister and current Khamenei adviser Ali Akbar Velayati; Tehran Mayor Mohammad Bagher Qalibaf and prominent lawmaker Gholam Ali Haddad Adel, whose daughter is married to Khamenei's son.

"Should we win, our coalition will form the backbone of the future government," Velayati told a press conference earlier this month, suggesting that the potential winner would seek key posts for the other two.

A separate roster of establishment-friendly candidates is getting bigger by the day. It includes former Intelligence Minister Ali Fallahian; parliament's vice speaker, Mohammad Reza Bahonar, and a former Revolutionary Guard commander, Mohsen Rezaei, who ran against Ahmadinejad in his disputed re-election in 2009.

Reformists remain undecided whether to fall behind a potential candidate or boycott the vote in protest of the 2009 outcome ? which they claim stole the election from Green Movement leader Mir Hossein Mousavi ? and the crushing pressures on dissent that followed. Mousavi and fellow reformist candidate Mahdi Karroubi have been under house arrest for more than two years.

But the most unpredictable element is still Ahmadinejad's push for Mashaei, whom he bills as his ideological heir and supporter of populist initiatives such as government stipends to poor families.

"Ahmadinejad will travel city to city and tell the public that they should vote for me if they want Ahmadinejad's plans to be pursued," Mashaei was quoted as saying by Iranian media.

The president ? the same man who calls for the destruction of Iran's enemies ? is often musing and sentimental as Mashaei's pitchman.

"I testify that this man loves all human beings," Ahmadinejad said of his in-law.

Mashaei, however, has been a political lightning rod for years. In 2009, Ahmadinejad appointed him as his first vice president, but was forced to backtrack on orders from Khamenei.

Mashaei is believed to have been Ahmadinejad's adviser in a stunning feud with Khamenei over the choice of intelligence chief in 2011. The president boycotted Cabinet meetings for 11 days ? an unprecedented show of disrespect to Iran's supreme leader ? but finally backed down.

In December, Ahmadinejad named Mashaei to a top post in the Nonaligned Movement, a Cold War holdover that Iran seeks to revive as a counterweight to Western influence. The appointment was seen as an attempt to raise Mashaei's political profile and give him some international experience.

While it's not possible to rule out any candidate until the vetting process is complete, one conservative cleric gives Mashaei no chance.

"The exalted supreme leader ordered that Mashaei is not qualified to serve as first vice president." said Qasem Ravanbakhsh. "So will the Guardian Council approve for president a man was not qualified to be the first vice president? Never."

High court hears case on federal benefits for gays

WASHINGTON (AP) ? In the second of back-to-back gay marriage cases, the Supreme Court turned Wednesday to a constitutional challenge to the law that prevents legally married gay Americans from collecting federal benefits generally available to straight married couples.

A section of the 1996 Defense of Marriage Act says marriage may only be a relationship between a man and a woman for purposes of federal law, regardless of state laws that allow same-sex marriage.

Lower federal courts have struck down the measure, and now the justices, in nearly two hours of scheduled argument Wednesday, will consider whether to follow suit.

A somewhat smaller crowd gathered outside the court Wednesday, mainly gay marriage supporters who held American and rainbow flags. One man wore a rainbow flag as a cape. "Two, four, six, eight, we do not discriminate," a group chanted at one point.

The DOMA argument follows Tuesday's case over California's ban on same-sex marriage, a case in which the justices indicated they might avoid a major national ruling on whether America's gays and lesbians have a right to marry. Even without a significant ruling, the court appeared headed for a resolution that would mean the resumption of gay and lesbian weddings in California.

Marital status is relevant in more than 1,100 federal laws that include estate taxes, Social Security survivor benefits and health benefits for federal employees. Lawsuits around the country have led four federal district courts and two appeals courts to strike down the law's Section 3, which defines marriage. In 2011, the Obama administration abandoned its defense of the law but continues to enforce it. House Republicans are now defending DOMA in the courts.

Same-sex marriage is legal in nine states and the District of Columbia. The states are Connecticut, Iowa, Maine, Maryland, Massachusetts, New Hampshire, New York, Vermont and Washington. It also was legal in California for less than five months in 2008.

The justices chose for their review the case of Edith Windsor, 83, of New York, who sued to challenge a $363,000 federal estate tax bill after her partner of 44 years died in 2009.

Windsor, who goes by Edie, married Thea Spyer in 2007 in Canada after doctors told them that Spyer would not live much longer. She suffered from multiple sclerosis for many years. Spyer left everything she had to Windsor.

There is no dispute that if Windsor had been married to a man, her estate tax bill would have been zero.

The U.S. 2nd Circuit Court of Appeals in New York agreed with a district judge that the provision of DOMA deprived Windsor of the constitutional guarantee of equal protection of the law.

Like the Proposition 8 case from California, Windsor's lawsuit could falter on a legal technicality without a definitive ruling from the high court.

The House Republicans, the Obama administration and a lawyer appointed by the court especially to argue the issue were to spend the first 50 minutes Wednesday discussing whether the House Republican leadership can defend the law in court because the administration decided not to, and whether the administration forfeited its right to participate in the case because it changed its position and now argues that the provision is unconstitutional.

If the Supreme Court finds that it does not have the authority to hear the case, Windsor probably would still get her refund because she won in the lower courts. But there would be no definitive decision about the law from the nation's highest court, and it would remain on the books.

On Tuesday, the justices weighed a fundamental issue: Does the Constitution require that people be allowed to marry whom they choose, regardless of either partner's gender? The fact that the question was in front of the Supreme Court at all was startling, given that no state recognized same-sex unions before 2003 and 40 states still don't allow them.

But it was clear from the start of the 80-minute argument in a packed courtroom that the justices, including some liberals who seemed open to gay marriage, had doubts about whether they should even be hearing the challenge to California's Proposition 8, the state's voter-approved gay marriage ban.

Justice Anthony Kennedy, the potentially decisive vote on a closely divided court, suggested the justices could dismiss the case with no ruling at all.

Such an outcome would almost certainly allow gay marriages to resume in California but would have no impact elsewhere.

There was no majority apparent for any particular outcome, and many doubts were expressed by justices about the arguments advanced by lawyers for the opponents of gay marriage in California, by the supporters and by the Obama administration, which is in favor of same-sex marriage rights. The administration's entry into the case followed President Barack Obama's declaration of support for gay marriage.

On the one hand, Kennedy acknowledged that same-sex unions had only become legal recently in some states, a point stressed repeatedly by Charles Cooper, the lawyer for the defenders of Proposition 8. Cooper said the court should uphold the ban as a valid expression of the people's will and let the vigorous political debate over gay marriage continue.

But Kennedy pressed him also to address the interests of the estimated 40,000 children in California who have same-sex parents.

"They want their parents to have full recognition and full status," Kennedy said. "The voice of those children is important in this case, don't you think?"

Yet when Theodore Olson, the lawyer for two same-sex couples, urged the court to support such marriage rights everywhere, Kennedy feared such a ruling would push the court into "uncharted waters." Olson said the court similarly ventured into the unknown in 1967 when it struck down bans on interracial marriage in 16 states.

Kennedy challenged the accuracy of that comment: He noted that other countries had had interracial marriages for hundreds of years.

The justice also made clear he did not like the rationale of the federal appeals court that struck down Proposition 8, even though it cited earlier opinions in favor of gay rights that Kennedy had written.

That appeals court ruling applied only to California, where same-sex couples briefly had the right to marry before the state's voters in November 2008 adopted Proposition 8, a constitutional amendment that defined marriage as the union of a man and a woman.

Reflecting the high interest in the cases, the court planned to release an audio recording of Wednesday's argument shortly after it concludes, just as it did Tuesday.

The Tuesday audio can be found at: http://tinyurl.com/dxefy2a .

    Harvey on copyright | Kiwiblog

March 26th, 2013 at 2:00 pm by David Farrar

Judge David Harvey has blogged a keynote speech he gave to the Australian Digital Alliance Forum on copyright law in the modern era. It?s a fascinating essay on the history of copyright, the changes over time, the balancing of rights etc.

He summarises his own proposal for copyright going forward:

?1. Copyright should not be seen as a property right ? either actual or inchoate

?2. A copyright owner?s rights should not be absolute.

?3. Copyright should be seen as an exception to the wider rights of freedom to receive and impart information guaranteed by Art. 19 ICCPR ? and, given copyright does not engage until expression (according to current copyright theory),? it must be subject to the supremacy of Article 19.

?4. Interference with Article 19 rights requires justification by the ?copyright owner?.[49]

?5. Once interference with the Art 19 right is justified, any restrictions to the general right and any advantages that accrue for the benefit of the ?copyright owner? may be permitted to the extent that they are:

    a) necessary to meet the copyright owners interests and justification and

    b) proportionate in terms of the extent of the interference

?6. Concepts such as fair use, protection term, remedies (and their extent) fall within the tests of necessity and proportionality rather than exceptions to a copyright owner?s right.

?I like the idea of the major right being the right to?receive and impart information, and copyright restrictions must fall within this right as justifiable limitations or exceptions. I think that is superior to having copyright as the ?major right? and then having to justify exceptions to copyright for purposes of quoting, parody, satire, academic scrutiny etc.

SAN FRANCISCO, CAMarch 25, 2012Shinya Yamanaka, MD, PhD, a senior investigator at the Gladstone Institutes, next month will receive the Essey Award for his "Commitment to a Cure" from The ALS Association Golden West Chapter. This annual award represents the exceptional determination, spirit and dedication to the fight against amyotrophic lateral sclerosis (ALS), also known as Lou Gehrig's disease.

This award, named after the Chapter's co-founder Richard Essey and his wife Sheila, this year recognizes the far-reaching, human-health impact of Dr. Yamanaka's Nobel Prize winning discovery of a way to transform adult skin cells into cells that act like embryonic stem cells. These induced pluripotent stem cells (or iPS cells) are so called because they can become any cell type in the body. Dr. Yamanaka's iPS discovery, first completed with animal cells in 2006 and with human cells in 2007, has since altered the fields of cell biology and stem cell researchopening promising new prospects for drug discovery, personalized medicine and tissue regeneration.

"I am pleased that scientists around the world are using this technology to search for solutions for many diseases, including ALS," said Dr. Yamanaka, who is also a professor of anatomy at the University of California, San Francisco, with which Gladstone is affiliated. "I am deeply honored that the Golden West Chapter is honoring my work in this way. Like them, I am optimistic that iPS cell technology will help find new solutions for those suffering from this devastating disease."

ALS is a neurodegenerative illness that causes progressive paralysisand eventually deathdue to the loss of motor neurons in the spinal cord and brain, which normally control muscle movement. Approximately 5,000 new cases of ALS are diagnosed in the United States each year, and despite recent progress in understanding the disease's underlying mechanisms, there is no known cure or treatment to halt or reverse the disease. Today, most people with ALS live only two to five years following diagnosis.

Approximately 30,000 people in the United States live with the disease at any given time, while the global population of ALS patients is approximately 400,000.

ALS is one of the many neurological diseases on which Gladstone focuses. Building on Dr. Yamanaka's discoveries, Gladstone investigators who specialize in ALS have developed the first iPS-based, human neuron model of the disease, which they are now using both to evaluate potential pharmaceutical compounds to treat it, and to better understand how the disease progresses on a molecular level.

"New therapies for ALS are urgently neededand our creation of human models using iPS cell technology will hopefully deepen our understanding of how the disease developsand lead to relevant therapies for patients," said Senior Investigator Steve Finkbeiner, MD, PhD, who leads ALS research at Gladstone.

"The ALS community is grateful to Dr. Yamanaka for his exceptional determination and dedication towards overcoming disease," said Fred Fisher, President and CEO of The ALS Association Golden West Chapter. "His discovery of iPS cells will allow for the exploration of human diseases like never before. While there has been significant progress in research, people with ALS and their loved ones still have far more questions than answers. The groundbreaking work of scientists like Dr. Finkbeiner and Dr. Yamanaka inspire confidence that there will soon be greater advancements in understanding the causes of the disease, developing new treatments and ultimately finding a cure for ALS."

Dr. Yamanaka, who did his postdoctoral training at Gladstone in the 1990s, also directs the Center for iPS Cell Research and Application (CiRA), and is a principal investigator at the Institute for Integrated Cell-Material Sciences (iCeMS)both located at Japan's Kyoto University. In 2007, he became a senior investigator at Gladstone, where he currently conducts his research at the Roddenberry Stem Cell Center.

This award comes on the heels of numerous other honors recognizing Dr. Yamanaka and the importance of his iPS discovery, including the 2012 Nobel Prize in Physiology or Medicine, the Breakthrough Prize in Life Sciences, the Millennium Technology Prize, the Albert Lasker Basic Medical Research Award, the Shaw Prize and the Kyoto Prize for Advanced Technology. In 2011, Dr. Yamanaka was elected to the National Academy of Sciences, garnering one of the highest honors available for U.S. scientists and engineers.

Dr. Finkbeiner will accept the Essey Award on behalf of Dr. Yamanaka at The ALS Association Golden West Chapter's annual gala, to be held at the Four Seasons Hotel in San Francisco on April 26th.

Zimbabwe court orders rights lawyer to be released

HARARE, Zimbabwe (AP) ? Zimbabwe's High Court orders the immediate release of a prominent rights lawyer detained for eight days for obstructing the course of justice.

Court officials said Beatrice Mtetwa was asked to post a $500 bail and her release papers will be prepared Monday.

High Court Judge Joseph Musakwa ruled that Mtetwa was following professional legal procedures when she demanded to see a search warrant from police at the offices of four officials in Prime Minister Morgan Tsvangirai's party. Those officials are accused of illegally compiling information on high level corruption and will appeal for bail later Monday.

Mtetwa and the four officials deny any wrongdoing.

Lawyers' groups have cited the arrests as intimidation against opponents of President Robert Mugabe by loyalist police and officials ahead of elections around July.

Ga. woman says she's certain suspect shot her baby

BRUNSWICK, Ga. (AP) ? The mother of a baby shot dead in his stroller took one look at a teenage suspect's jailhouse mugshot Saturday and said he was definitely the killer. Yet an aunt of the teen said he was eating breakfast with her when the slaying took place.

Despite the conflicting stories, police have charged 17-year-old De'Marquise Elkins with murder, along with a 14-year-old suspect whose name has been withheld because he's a juvenile.

Brunswick police spokesman Todd Rhodes said even though Elkins' aunt provided an alibi, authorities have good reason to bring the charges.

"That's what she's saying, but the evidence we're looking at says something else," Rhodes said, though he would not elaborate.

Also Saturday, police in this coastal port city released 911 recordings from neighbors who sobbed and pleaded for help right after 13-month-old Antonio Santiago was shot in the head a few blocks from his mother's apartment.

Sherry West said she was pushing her baby in his stroller as she walked home from the post office Thursday morning. She said a teenager, with a younger boy behind him, approached and asked her for money. West said when she told him she had no money, the teen drew a gun and said: "Do you want me to kill your baby?"

The gunman opened fire and West was shot in the leg, while another bullet grazed her left ear, she said. She watched helplessly as the gunman shot her son in the face, she said.

Two teddy bears, a vase of flowers and a decorative cross had been left Saturday against a wooden fence near the shooting scene.

Katrina Freeman said Saturday the shooter can't be her nephew, Elkins, because he showed up at her house Thursday at 8:15 a.m. ? roughly an hour before the killing. She said she cooked eggs, grits and sausage for breakfast and that Elkins accompanied her and her children to run errands when they left at about 11:30 a.m.

"He was with us the whole time," said Freeman, adding that she gave police the same account of her nephew's whereabouts. "There is no doubt in my mind that he is innocent."

The slain boy's mother said she picked the gunman out of a photo lineup of 24 mugshots police brought to her Friday. When a reporter showed her the photo of Elkins taken when he was booked into the Glynn County jail Friday, she wept and nodded.

"He killed my baby, and he shot me, too," she said.

At her apartment Saturday, West had filled several bags with her son's clothes and diapers to donate to charity. She said she hopes prosecutors pursue the death penalty in the case.

"My baby will never be back again," West said, sobbing. "He took an innocent life. I want his life, too."

In 2008, West's 18-year-old son was stabbed to death in an altercation in New Jersey. Prosecutors said the stabbing was self-defense and did not file charges.

In Georgia, police said they are still searching for the gun. No eyewitnesses have come forward.

In the 911 recordings, two callers said they heard gunshots and then saw West take her son out of his stroller, lay him on the ground and try to revive him using CPR.

"Yes, I heard the shots. Somebody shot this child," said one sobbing caller, who told the operator there were three shots fired. "She's got him on the ground. Please, we need everything we can get."

The 911 operators asked the callers if the boy was breathing. Finally, a man in a grave voice, answers: "No, the baby's not breathing." He says the child was shot "right between the eyes."

A woman can be heard screaming in the background just before police arrive. Sirens drowned out her cries.

Elkins' relatives said Saturday they don't know if he has an attorney. His older sister, Sabrina Elkins, said police arrested him as he came to her home Friday.

"The police came pointing a Taser at him, telling him to get on the ground," she said. "He said, 'What are you getting me for? Can you tell me what I did?'"

The suspect's sister said he returned to Brunswick a couple of months ago after living in Atlanta for a while. While he wasn't enrolled in high school, she said, he had been taking classes to earn his GED.

"He couldn't have done that to a little baby," Sabrina Elkins said. "My brother has a good heart."

Ethics committee investigates Reps. Young, Andrews

WASHINGTON (AP) ? The House Ethics Committee said Tuesday it is forming a special panel to investigate whether Alaska Rep. Don Young failed to report gifts on his annual disclosure forms, misused campaign funds and lied to federal officials. The committee also announced a separate special panel will examine whether New Jersey Rep. Rob Andrews broke House rules by using campaign funds for personal travel.

The allegations against Young, a Republican who has served in the House since 1973, focus on his expenses and travel costs for trips that were already the subject of an ethics investigation. The investigative subcommittee will look at whether he, or persons acting on his behalf, obtained or received improper gifts, misused official resources or campaign funds for personal use or failed to report gifts on required disclosure statements.

The committee said in a statement that it will investigate the allegations after a referral from the Department of Justice. The department had previously investigated allegations Young accepted gifts in exchange for political patronage.

Michael Anderson, a spokesman for Young, said Young would cooperate with the investigation.

"Congressman Young has cooperated with the committee and will continue to do so," he said.

The allegations against Andrews involve whether the Democrat improperly used campaign funds for personal trips, including a wedding in Scotland and numerous trips to California with his daughter, who has a fledgling career as a singer and actress. The case was referred to the House Ethics Committee by the independent Office of Congressional Ethics.

A report the OCE, released in August of last year, said Andrews' trip to Edinburgh, Scotland -- including four business class tickets for himself and his family -- was either paid for or later reimbursed by Andrews' campaign accounts.

Andrews said he expected the investigation to clear him.

"As I have previously stated, this continuing review by the House Ethics Committee will establish and confirm that I have always followed all the rules and met all the standards of the House," Andrews said.

Andrews said he will "eagerly provide" all the information requested by the committee.

The panel investigating Andrews will be led by Rep. Trey Gowdy, R-S.C. The panel investigating Young will be led by Rep. Patrick Meehan, R-Pa. The committee said in its statement announcing the panels that the investigative subcommittees will determine whether the lawmakers violated the House's Code of Official Conduct.

The committee, in its statement, also makes clear that the establishment of the subcommittee does not indicate that any violation had occurred.

Can a tropical water flea invade European lakes?

    Wednesday, March 20, 2013

Daphnia is a genus of small, planktonic crustaceans, commonly called 'water fleas' because of their jumpy swimming style and their size (between 0.2 and 5 mm). They live in various aquatic environments, ranging from acidic swamps to freshwater lakes, ponds, streams and rivers. Species of the genus Daphnia play a key role in freshwater food webs: they consume algae and are themselves an important food item for small fish.

Daphnia lumholtzi is a small subtropical and tropical representative, known as an invader in North America. It has never been found in Europe in the wild. Laboratory experiments were conducted by scientists from Ludwig-Maximilians-Universit?t M?nchen; University of Bayreuth; and Technische Universit?t, M?nchen, to assess the possibilities of a potential invasion in Europe. The study was published in the open access journal NeoBiota.

The experiments suggest that D. lumholtzi can invade European lakes and can cause substantial declines in the populations of native water flea species, e.g. Daphnia hyalina and D. cucullata. It was also shown that absence of predatory fish may ease establishment in European lakes. Surprisingly, the invasive plankter proved to be a strong competitor even at temperatures as low as 15?C, despite its tropical origin.

"We still do not know whether D. lumholtzi will invade European lakes, but our experiments did not identify any obstacles. In contrast to some studies suggesting that it might be filling an empty niche in North America, the results of our experiments indicate that it may suppress the population growth or even outcompete some native European Daphnia" says the lead author Meike J. Wittmann.

America's Infrastructure Receives D+ Grade - Environmental Leader

America?s infrastructure will need an estimated $3.6 trillion in total investment by 2020, leaving a funding shortfall of $1.6 trillion, according to an assessment by the American Society of Civil Engineers.

The 2013 Report Card for America?s Infrastructure, which is updated every four years, gave the performance and condition of the nation?s infrastructure an overall grade of D+, up from a D in 2009. The study evaluated 16 sectors that include solid waste, the power grid, drinking water, wastewater, roads and bridges.

None of the 16 categories received a lower grade than in 2009, according to the report. However, near-failing grades were given to a number of sectors, including levees and inland waterways.

The nation?s energy grade remained a D+. The ASCE warned in the report the availability of energy will become a greater challenge after 2020. Some 17,000 miles of additional high-voltage transmissions lines as well as oil and gas pipelines are planned for the next five years. However, permitting and siting issues threaten their completion, the ASCE said.

Dams maintained a D grade, in part because of an increase in the nation?s aging and high-hazard dams. Many of these were built as low-hazard dams to protect agricultural land. However, population shifts and development have increased the number of high-hazard dams to nearly 12,000 in 2012, the report said. The number of deficient dams is more than 4,000, the ASCE said.

An analysis conducted by the US Department of Energy last year found existing dams across the country could provide more than 12 GW of additional electric generating capacity, the equivalent of roughly 15 percent of the nation?s hydropower capacity.

Some sectors saw their grades stabilize or improve. Solid waste, drinking water, wastewater, roads, bridges and rail each had small improvements in their grades since the last assessment.

Cities and states renewed efforts to address deficient roads, bridges, drinking and wastewater systems, and private investment for efficiency and connectivity improved the nation?s railways, ports and energy grid. Several infrastructure categories benefited from short-term boosts in federal funding, the ASCE said.
